GDPR sets out the clear framework for consent and transparency. Transparency is required for both data and algorithm, but as bias is difficult to detect in the algorithm itself and ultimately it is only through assessment of real-life cases that discrimination is detectable.
This is an important consideration, with significant implications in practice.
